US Limits Powers of Federal Agencies
On October 9, 2019, the US President issued two new executive orders Executive Order on Promoting the Rule of Law Through Improved Agency Guidance Documents and Executive Order on Promoting the Rule of Law Through Transparency and Fairness in Civil Administrative Enforcement and Adjudication. The intent of these orders is to increase transparency in the rule-making and enforcement powers of US federal agencies like the US SEC, FTC and PTO which enforces securities, competition/privacy and intellectual property laws of the United States, respectively.
These orders can also be used to find legal arguments against certain agency actions or interpretations. Stay tuned as industry begins to grapple with the effects of these orders.
